1. Acceptance of Terms

By accessing and using CallScribe ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

CallScribe is an AI-powered phone assistant service that:

• Answers forwarded calls on your behalf
• Records and transcribes voicemail messages
• Provides AI-generated summaries and categorizations
• Sends email notifications with call details
• Detects and flags spam and fraud calls

3. User Account and Registration

3.1 Account Creation

You must create an account to use CallScribe. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Phone Number Verification

You must verify ownership of your phone number to use the Service. Only verified phone numbers can forward calls to CallScribe.

4. Subscription and Payment

4.1 Subscription Plans

CallScribe offers two subscription plans:

• Monthly Plan: $14.99/month, billed monthly
• Annual Plan: $149/year (equivalent to $12.42/month), billed annually with 3-day free trial

4.2 Free Trial

Annual plan subscribers receive a 3-day free trial. You will not be charged until the trial period ends. You may cancel during the trial period to avoid charges.

4.3 Payment

All payments are processed securely through Stripe. By providing payment information, you:

• Authorize us to charge your payment method
• Agree to pay all fees and charges
• Are responsible for all applicable taxes

4.4 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You will be charged at the then-current rate unless you cancel.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

5.2 Refund Policy

We do not provide refunds for partial months or years. If you cancel during a free trial, you will not be charged.

6. Acceptable Use

You also agree NOT to:

• Use the Service for any illegal purpose
• Violate any laws or regulations, including wiretapping and recording consent laws
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service to spam or commit fraud
• Reverse engineer or copy our technology
• Share your account with others
• Exceed fair-use limits (see Section 6.1 below)

6.1 Fair-Use Policy

While we offer "unlimited" personal calls, this is subject to fair-use policy to prevent abuse:

• Service is for personal use only, not commercial call center operations
• Excessive usage that significantly exceeds normal personal use may be flagged
• We reserve the right to suspend accounts with abnormal usage patterns
• Typical personal use: up to 100 calls per month is considered normal

7. Call Recording and Legal Compliance

By using CallScribe, you acknowledge and agree that:

• Automatic Recording: CallScribe will record all calls forwarded to the service
• Your Legal Responsibility: You are solely responsible for complying with federal, state, and local call recording and wiretapping laws
• Consent Requirement: In many jurisdictions, you must obtain consent from all parties before recording. You are responsible for obtaining this consent.
• Default Greeting: CallScribe provides a standard greeting informing callers they are speaking with an AI assistant and that the call may be recorded
• Custom Greeting: If you customize the greeting, you must ensure it adequately notifies callers of recording
• One-Party vs. Two-Party States: Some states require all parties to consent (two-party consent), while others require only one party (you) to consent. Know your local laws.

Examples of recording laws: California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, and Washington require two-party consent. Other states generally require one-party consent. This is not legal advice - consult a lawyer if unsure.

8. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free service
• 100% accuracy of AI transcriptions or summaries
• Detection of all spam or fraud calls
• Compatibility with all phone carriers

We may modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Intellectual Property

CallScribe and its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your call recordings and data. You grant us a license to process and store this data to provide the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLSCRIBE SHALL NOT BE LIABLE FOR:

• Missed calls or failed recordings
• Inaccurate transcriptions or summaries
• Undetected spam or fraud calls
• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities

Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

11. Indemnification

You agree to indemnify and hold CallScribe harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms of Service
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Abuse or misuse the Service

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by the laws of the United States and the State of California, without regard to conflict of law provisions.
